SOCIAL MEDIA HAS NO MORAL AUTHORITY TO WRONGLY LABEL THE PROFILES OF "SEXUALIZED" YOUNG PEOPLE. THE APOLOGY IS TOO LATE

LEGISLATIVE DOCUMENT: 

BILL PROPOSAL 

To understand the debate surrounding this major commercial fraud, it is important to understand the context of the issue from the perspective of a financial investigation.

The Infrastructure is Paid for by The User.

The problem: A parent, in order for their children to have a decent education like the rest of their community, is nowadays obligated to purchase internet service. Having internet at home has become an additional service tied to cable television. The cost of this home internet service is approximately 30 dollars (with variations ranging from 25 dollars in Latin American countries to 55 dollars in the United States and Europe). In addition to this, every user who registers on a social network consumes phone data when they are out in the street. That specific expense for data plans is approximately 7 dollars per month. All of this adds up to an approximate expense of 60 dollars, which is added to the total cost of purchasing a mobile phone, which nowadays is around 100 dollars per month.

Additional Services Are Paid For by The User.

Social networks create additional services through subscriptions or verified accounts (e.g., Meta Verified). This maneuver adds another expense for young users who seek not to be excluded. In total, for their child to use a social network, a parent must spend between 15 and 25 additional dollars per month on verification subscriptions, added to the cost of maintaining internet service on the phone and at home, generating a combined total expense of between 130 and 150 dollars per month for each child within the technological system. The worldwide revenue under this premise: Without counting affiliated companies (that is, calculating only the traffic and infrastructure contributed by users), Instagram collects billions. Taking into account affiliated companies and the advertising placed on that traffic paid for by parents, Instagram's worldwide revenue currently approaches 60 billion dollars annually.

The Moral Asymmetry. Social Networks Create The Environment For Sexualization.

The creation of rewards, verification logos, badges, and reward systems within Instagram are, in themselves, sexualized acts and forms of digital gambling. They are designed to stimulate adolescents' dopamine, pushing them to compete for visual status through the exposure of their own bodies.

Stage 1: The Local Bait

Instagram indirectly associates itself with small local companies from cosmetics, fashion, and event agencies that contact clubs of dancers, swimmers, content creators, runners, or volleyball players, as well as fashion photographers and sports club photographers.

The victim: The influencer or athlete with the largest number of users and the greatest reach within that group.

What they receive for free: Gifts, brand products (commonly cosmetics), and invitations to events. In addition, they receive viral posts guaranteed by Instagram's algorithm if they attend that event and promote that product.

Risks identified: The minor is integrated with other minors into an environment of aggressive advertising. She is made up and dressed in suggestive clothing. She is associated with other minors who fulfill the role of suggestive participants, promoting her attractiveness or the "advertising contact." In short, they lay the foundations for youth sexualization.

Stage 2: Group Grooming or Mass Environmental Recruitment

To feed this system, they bring young men into the environment to share dinners or provide companionship and protection. Where do these young men come from? They come from other agencies that are commonly agencies created by pimps or partners in erotic content, cleverly disguised under the title of "Talent Agency." The ultimate objective is to encourage physical contact, create controlled discomfort, offer false protection, and establish a bond of trust in order to isolate the victim from her family environment and bring her into the business.

The Selective Sanction Maneuver and Regional Control

At this stage, Instagram applies a financial and control maneuver. Whom does it actually sanction?

  • Instagram does not sanction sexualized minors who have verified accounts.
  • It sanctions sexualized minors who cannot afford verified accounts.

By sanctioning the young woman's account, Instagram destroys her reputation and harms the 30,000 users who followed her account. This moral damage is not minor: by closing the user's account, Instagram publicly states that it was "because of her content" or "because she does not comply with the company's policies." This not only insults the content that the young person generated, but also fails to take into account that this user generated 30,000 additional users for the platform, whom Instagram also disrespects.

What Level of Morality Does a Corporation Possess to Classify a Minor as "Sexualized" When it is The Social Network That Uses Her Image?

To understand this issue, is it necessary to know how the algorithm operates?

The algorithm operates under the metric optimization known as (Engagement-Driven Optimization).

Main Function: the algorithm searches for (published images) those with the highest retention rate per second. Conceptually, it does not care about the content of the image; it monitors the speed at which users retain their gaze or interact in specific geographic regions.

Through artificial vision neural networks (Computer Vision), the social network has an algorithm that analyzes every pixel of an image when it is uploaded. It detects general biometric parameters (approximate age, gender, environment).

It selects unverified accounts without strict parental controls. The algorithm classifies it as a resource for free mass distribution. The image is indexed in a recommendation cluster that determines that this content has "High Retention Value" This is where the platform's economic benefit materializes, through a technique called Ad Adjacency.

The algorithm structurally concatenates advertising (in Reels or Stories format) immediately before, during, or after the user consumes the high-retention content. In this way, corporate advertisements from various industries end up appearing alongside highly inappropriate content or accounts belonging to vulnerable minors. Example: if the image is of a minor, it will appear alongside advertisers of toys or swimsuits. The problem is that the exposed minor receives no economic benefit, when in reality her image was displayed and viewed for the benefit of the platform.

The Maneuver Occurs Automatically:

The algorithm is not passive; it takes affirmative action by packaging, promoting, and directing the content toward recruitment networks or users who interact for criminal purposes in order to retain them on the platform.

By providing the infrastructure for massive and geolocated distribution that connects the "bait" with the consumer, this creates visible evidence that the social network acts as a facilitator or necessary accomplice in the chain of distribution of child exploitation material, turning user exploitation into an internal business line. This constitutes contractual fraud and severe reputational harm to advertisers, who involuntarily finance social networks.

Instagram judges and morally punishes the victim whom it itself pushed toward overexposure, destroying her reputation within her community in order to stage a compliance theater before governments, while simultaneously protecting pimping networks that do pay for their verified accounts.

Statement of Crimes Committed Based on Its Own Documentation and Approach

By unilaterally classifying a minor as "sexualized" in order to close her account and destroy her social reputation, when her content is perfectly accepted by her immediate family and social environment, Instagram is not applying neutral moderation. It is carrying out a corporate act that exposes the company to serious crimes and legal classifications under criminal and international law:

1. Corporate Defamation, Slander, and Libel

By issuing an automatic notice stating that the account was closed "for failure to comply with service policies" in the context of sexual content, Instagram publicly labels the minor before her 30,000 followers and her actual community as an offender or generator of inappropriate material.

The Offense: This constitutes aggravated slander and defamation, since the platform uses its monopolistic power to falsely attribute dishonorable conduct to a minor, causing her moral harm and social isolation in real life.

2. Violation of the Best Interests of the Child and Digital Violence (International Treaties)

Under the Convention on the Rights of the Child, corporations are prohibited from taking actions that violate the psychological integrity of minors.

The Offense: By taking a legitimate photograph (of dancing, swimming, or volleyball) out of context, packaging it within its traffic algorithm to generate money, and then punishing the minor by destroying her social capital in order to "clean up" its corporate image before governments, Instagram commits Digital and Institutional Violence. 

It Is Revictimization: the platform induces the risk scenario and then punishes the victim.

3. Actual Damages and Loss of Profits (Civil/Commercial Offense)

That account, with thousands of followers that the minor managed to obtain, represents years of hard work financed by her parents. By deleting it without real justification and without providing a right to a human defense or legitimate appeal, an arbitrary confiscation of digital assets occurs.

The Offense: This constitutes an abuse of contractual rights and unlawful appropriation of value, generating direct economic harm to a legitimate communication channel authorized by the minor's legal guardians.

4. Arbitrary Discrimination and Socioeconomic Bias

By protecting sexualized minors with verified accounts who pay for a subscription and deleting unverified minors who do not have the resources to pay for the Meta Verified service, the company engages in discriminatory commercial bias.

The Offense: This constitutes a serious violation of consumer protection and non-discrimination laws. The platform decides which minor is an "offender" and which one is a "creator" based exclusively on a criterion of monetization and economic income.

Why Doesn't Instagram Place an AI Assistant for Each User to Provide Warnings Before Posting?

If Meta currently possesses the technology to assign a personalized Artificial Intelligence assistant to each profile, the question is unavoidable: Why does the system not warn the user before they upload an image that violates the policies, allowing them to adapt it, pixelate it, or transform it into a meme in order to avoid the violation?

The Answer Is Strictly Economic And Algorithmic: Distributing the image for months is more profitable than destroying it. How does the maneuver work?

The "Traffic Funnel" Trap: If AI stopped the publication on the user's phone before it was uploaded, the image would never reach Instagram's servers. By allowing it to be published, Instagram receives, stores, and processes the visual data. Even if it is a sexualized image of a minor, that content generates an immediate spike in interactions (*Engagement*), bot comments, and traffic that keeps thousands of users connected while consuming the attached advertising.

The "Squeezing the Content" Strategy: The platform applies a policy of calculated obsolescence. They allow the image to circulate long enough to extract the maximum advertising revenue and regional virality from it. Once the content has already been "squeezed" economically and fulfilled its traffic quota for the company's statistics, the AI acts "late" and deletes the account, washing its hands before regulatory authorities.

Free Training of Its AI: Meta uses prohibited images from unverified users to feed and train its own language and visual recognition models. If they blocked uploads from the outset, they would lose the raw material they need to improve their commercial technology.

1. The Following Crimes Are Classified in This Maneuver:

Criminal Negligence Through Complacent Omission: By possessing the technical tools to prevent the dissemination of risky material and deciding not to implement them in order not to lose traffic, the company moves from being a neutral intermediary to an indispensable technical facilitator for the recruitment of young people vulnerable to its policies because they do not have a verified account.

Money Laundering and Financial Violation (Lack of Auditing): Who audits the distribution of revenue from rewards, subscriptions, badges, and gifts? In the absence of clarity regarding the payment gateways connecting Instagram's monetization tools with front agencies for erotic content, the platform operates as a channel of financial opacity that processes money originating from the exploitation of minors' attention.

Instrumental Use of Responsibility Facades (Social Washing): The platform claims to be associated with international organizations such as the National Center for Missing & Exploited Children (NCMEC) or Missing Children. However, the H1 2026 report demonstrated that images circulate massively before being reported. They use these partnerships as a public relations shield to simulate control while their servers continue operating the financial market of youth attention.

Commercial Fraud and Contractual Fraud: Instagram confiscates years of users' work through unilateral automated cancellations, without the right to reply or return of the value generated, constituting illicit enrichment at the expense of the user's family's economic sacrifice.

Instagram's failures are not "system errors," but financial engineering decisions designed to generate revenue. There are already formal precedents of journalistic and judicial investigations demonstrating that the monetization tools of social networks are based on the sexualization of minors.

The Wall Street Journal Case (2024)

An exhaustive investigation by the Wall Street Journal revealed internal reports from Meta in which its own safety employees warned that subscription systems and the "Gifts" system were being exploited by adult networks to monetize the content of minors and vulnerable profiles under modeling facades. Meta ignored the warnings from its team in order to continue expanding monetization.

The New Mexico Attorney General's Lawsuit (2024)

New Mexico Attorney General Raúl Torrez formally sued Meta after discovering through undercover agents that Instagram's subscription tools had become a direct financial market for recruitment and exploitation networks, operating with AI filters that were completely ineffective and that criminals easily evaded.
